El objetivo del artículo es describir la fenomenología jurídica de Adolf Reinach, apuntar algunos posibles desarrollos de la misma y esclarecer su contribución a la filosofía del derecho contemporánea. En primer lugar, se traza una breve biografía intelectual de su autor, para pasar, tras un breve análisis de su obra sobre La Premeditación, al análisis de la teoría de los actos sociales y la exposición de la necesidad y posibilidad de una ciencia jurídica cuyas proposiciones sean sintéticas y a priori. (...) Por último, se analiza la relación de esta ciencia que describe los estados de cosas jurídicos, con la ciencia jurídica empírica y las disposiciones del derecho positivo. This article is a review and reflection of the new elements of rights and laws, applied to the principle of justice and sovereignty, but above all in the demonstration that law as a science once again allows us to conceive that as a science it evolves and must be modified according to the new conducts that the State and society require, such is the case of the constitutional recognition that this type of rights have. In the last decades, human beings (...) have evidenced that the way in which they interact with nature is causing serious consequences to the ecosystems that compose it. In the past, these consequences were not yet evident and, therefore, the environmental awareness that exists today did not exist. En la historia intelectual de América Latina existe una laguna respecto a la producción de las mujeres en el género de ensayo. Son los ensayos de identidad criolla, de hechura masculina, los que construyen el canon respecto a las temáticas y a las maneras de ser abordado. Los ensayos de género que las escritoras han realizado se articulan como respuesta a esta visión dominante de los procesos sociales, políticos y culturales de los países latinoamericanos. Revelan un fuerte descontento con la (...) construcción de la identidad femenina, una preocupación por la construcción de una ciudadanía plena y representan una respuesta a las demandas sociales políticas y culturales de las mujeres y otros grupos marginales. Las intelectuales debatieron, discutieron y polemizaron con las propuestas que al respecto portaban los discursos dominantes y el ensayo de género se vuelve el “arma de combate”. Lo que aquí se presenta, tiene como objetivo la recuperación de este corpus de conocimiento en la historia literaria de Cuba, Puerto Rico y República Dominicana. Una labor de arqueología literaria de temas, obras y autoras a partir del siglo XX. Se brinda, a partir del libro Mujeres ensayistas del Caribe Hispano: Hilvanando el silencio (2007) deAnna Freire Ashbaugh, Lourdes Rojas y Raquel Romeu, una visión panorámica del conjunto de ensayistas de cada país. Otras investigadoras como Catharina Vallejo, Ivette Sóñora, Carmen Dolores Hernández y Consuelo Meza Márquez ampliaran ese corpus y señalan algunos rasgos temáticos de la obra ensayística de autoras como Luisa Campuzano, Mirta Yáñez, Nara Araujo, Marta Núñez Sarmiento y Zaida Capote Cruz de Cuba; Concha Meléndez, Rosario Ferré, Norma Valle Ferrer, Nara Negrón Marreño y Silvia Álvarez Curbelo de Puerto Rico; y, de República Dominicana, Camila Henríquez Ureña, Carmita Landestoy, Carmen Durán y Rosa Inés Curiel Pichardo. The Fairness, Accountability, and Transparency (FAccT) literature tends to focus on bias as a problem that requires ex post solutions (e.g. fairness metrics), rather than addressing the underlying social and technical conditions that (re)produce it. In this article, we propose a complementary strategy that uses genealogy as a constructive, epistemic critique to explain algorithmic bias in terms of the conditions that enable it. We focus on XAI feature attributions (Shapley values) and counterfactual approaches as potential tools to gauge these conditions (...) and offer two main contributions. One is constructive: we develop a theoretical framework to classify these approaches according to their relevance for bias as evidence of social disparities. We draw on Pearl’s ladder of causation (Causality: models, reasoning, and inference. Cambridge University Press, Cambridge, 2000, Causality, 2nd edn. Cambridge University Press, Cambridge, 2009. doi:10.1017/CBO9780511803161) to order these XAI approaches concerning their ability to answer fairness-relevant questions and identify fairness-relevant solutions. The other contribution is critical: we evaluate these approaches in terms of their assumptions about the role of protected characteristics in discriminatory outcomes. We achieve this by building on Kohler-Hausmann’s (Northwest Univ Law Rev 113(5):1163–1227, 2019) constructivist theory of discrimination. We derive three recommendations for XAI practitioners to develop and AI policymakers to regulate tools that address algorithmic bias in its conditions and hence mitigate its future occurrence. Throughout the 20th century, market capitalism was defended on parallel grounds. First, it promotes freedom by enabling individuals to exploit their own property and labor-power; second, it facilitates an efficient allocation and use of resources. Recently, however, both defenses have begun to unravel—as capitalism has moved into its “platform” phase. Today, the pursuit of allocative efficiency, bolstered by pervasive data surveillance, often undermines individual freedom rather than promoting it. And more fundamentally, the very idea that markets are necessary to achieve (...) allocative efficiency has come under strain. Even supposing, for argument’s sake, that the claim was true in the early 20th century when von Mises and Hayek pioneered it, advances in computing have rekindled the old “socialist calculation” debate. And this time around, markets—as information technology—are unlikely to have the upper hand. -/- All of this, we argue, raises an important set of governance questions regarding the political economy of the future. We focus on two: How much should our economic system prioritize freedom, and to what extent should it rely on markets? The arc of platform capitalism bends, increasingly, toward a system that neither prioritizes freedom nor relies on markets. And the dominant critical response, exemplified by Shoshana Zuboff’s work, has been to call for a restoration of market capitalism. Longer term, however, we believe it would be more productive to think about how “postmarket” economic arrangements might promote freedom—or better yet, autonomy—even more effectively than markets, and to determine the practical steps necessary to realize that possibility. Sometimes subjects have sufficient internal and external resources to retrieve information stored in memory, in particular information that carries socially charged content. Yet, they fail to do so: they forget it. These cases pose an explanatory challenge to common explanations of forgetting in cognitive science. In this paper, I take this challenge and develop a new explanation of these cases. According to this explanation, these cases are best explained as cases of norm-induced forgetting: cases in which forgetting is caused by (...) social norms in a relevant sense. These cases draw attention to the normative aspects of the mechanisms of forgetting. This is an important but neglected aspect of cases of everyday forgetting, in particular of those characterized by a social dimension. By investigating some ways in which the psychology of social norms is causally relevant in the mechanisms of retrieval failure, I begin to fill this gap. (shrink)

At this time when the development of synthetic biology and artificial intelligence are changing the world around us, philosophers and scientists, first of all, must converge to analyze the present and predict the ethical-social consequences and biological dangers associated with new “living entities” that are not the result of the natural evolutionary process. As synthetic/artificial life forms (xenobots, robots, transgenic organisms, etc.) become more and more abundant and sophisticated, it seems first of all necessary to bring some order to all (...) this new biodiversity, establishing what is alive and what is not, and analyzing the consequences of this incessant creative activity. Here I intend to organize all these human-made entities and clarify their status as living beings or artificial elements, leaving the door open to an uncertain future in which we will be able to see how “the artificial” and “the natural” could merge to originate something different from everything known. Accordingly, I propose the creation of a new domain, Lithbea, which includes all synthetic and artificial entities within a new kingdom called Humade (derived from human-made). I have also included viruses in a new realm, the Viral kingdom, because they were excluded from the classical three-domain tree of life despite playing a fundamental role in the evolution of biodiversity on Earth. Finally, I make a brief comment on the unpredictability of the unknown, the implications of this new landscape of biodiversity, and the uncertain future of all these advances. (shrink)

The central idea behind this paper is that presuppositions of soft triggers arise from the way our attention structures the informational content of a sentence. Some aspects of the information conveyed are such that we pay attention to them by default, even in the absence of contextual information. On the other hand, contextual cues or conversational goals can divert attention to types of information that we would not pay attention to by default. Either way, whatever we do not pay attention (...) to, be it by default, or in context, is what ends up presupposed by soft triggers. This paper attempts to predict what information in the sentence is likely to end up being the main point (i.e. what we pay attention to) and what information is independent from this, and therefore likely presupposed. It is proposed that this can be calculated by making reference to event times. The notion of aboutness used to calculate independence is based on that of Demolombe and Fariñas del Cerro (In: Holdobler S (ed) Intellectics and computational logic: papers in honor of Wolfgang Bibel, 2000). Human identity is a complex process linked to the subject and his environment, both constantly evolving. Personality is developed and changed throughout lifetime, but it has a core that remains constant. Thus a person can secure his continuity; he recognizes himself and is recognized by the others as time goes by. In fact, we are all the same, even after experiencing changes and years later. The constitution of the other and the self are – from the phenomenological point of view (...) – two components of the same process, which is the origin of the subjectivity of self and the objectivity of me. These are conditions for the identity’s construction, a continuous process that takes place throughout time. Human tendency to the community emerges with priority from the above definition. That deep desire of being part of a social group interprets others as constituent of the identity of the self. “Having an identity” actually means not only a set of characteristics noticed by ourselves after actions done or the “image” of us, but also to be recognized by the rest of society. Therefore, community turns out in the ultimate horizon that responds to an individual’s recognition need. The recognition of self by me is linked to the issue of the recognition of self through the other until mutual recognition as reciprocal act is reached. Hence, “gift” becomes an emblem of mutual recognition, highlighting the relational and inter-subjective structure of the person. The identity development goes through the mutual recognition experience and gift. Somebody who gives himself recognizes the others and simultaneously, participates in his constitution and his self-understanding. (shrink)

Some presuppositions are easier to cancel than others in embedded contexts. This contrast has been used as evidence for distinguishing two fundamentally different kinds of presuppositions, ‘soft’ and ‘hard’. ‘Soft’ presuppositions are usually assumed to arise in a pragmatic way, while ‘hard’ presuppositions are thought to be genuine semantic presuppositions. This paper argues against such a distinction and proposes to derive the difference in cancellation from inherent differences in how presupposition triggers interact with the context: their focus sensitivity, anaphoricity, and (...) question–answer congruence properties. This article aims to improve the knowledge on Generation Z as employees within workforce and in the workplace, as well as on the main thematic trends that drive the research on the topic. To this end, and using bibliometric techniques, a sample of 102 publications on this subject from Web of Science between 2009 and 2020 is analyzed. Research discusses the most published and most cited authors and journals to have a broad view of the context of the subject. Later, (...) through a longitudinal view, the study mainly focuses on analyzing the evolution of thematic clusters, to assess the progress of the themes, as well as the network around the principal motor cluster of each period. The obtained results suggest a hardly developed topic, which started to draw attention in 2018, while still having a wide margin for growth. The core of research on the topic has evolved around “Generation-Z” “generations,” “workplace,” “management” and “attitudes,” “leadership,” “career,” or “learning-teaching-education,” although a low keyword stability among periods was noted. There is a need for further development on a variety of aspects regarding this generation and the labor market, as the study shows a clear orientation toward management and generational diversity within the workplace. This paper examines a little studied type of perspective shift that I call protagonist projection, following Holton :625–628, 1997). PP is a way of describing the mental state of a protagonist that conveys, to some extent, her perspective. Similarly to its better known cousin free indirect discourse, the shift in perspective is achieved without an overt operator. Unlike FID, PP is not based on a presumed speech-act of a protagonist. Rather, it gives a linguistic form to pre-verbal perceptual content, sensations, (...) feelings or implicit beliefs. I propose to analyse PP in a bi-contextual framework, extending Eckardt’s approach to FID. Under the resulting analysis, FID and PP are two instances of a more general category of perspective shift. The main objective of this study is to propose, from a theoretical approach, an alternative model of the communication process that includes intentionality, interest, identification, and exchange as part of the internal process of decoding the message experienced by the receiver. The proposal includes the subdivision of the responses offered by the receiver into two possible categories: one simple, which can mean the programmed response to a specific code; and another complex, which can mean a change and/or significant transformation in (...) different aspects associated with the recipient. Through a qualitative methodology, with emphasis on documentary review, and inferential and deductive reasoning, the proposed theoretical model has been developed and explained, highlighting the added value that it could offer to the understanding of communication. Electricity is an indicator that shows the progress of a civilization; it is a product that has greatly changed the way we think about the world. Electricity price forecasting became a fundamental task in all countries due to the deregulation of the electricity market in the 1990s. This work examines the effectiveness of using multiple variables for price prediction given the large number of factors that could influence the price of the electricity market. The tests were carried out over four (...) periods using data from Spain and deep learning models. Two different attribute selection methods based on Pearson’s correlation coefficient have been used to improve the efficiency of the training process. The variables used as input to the different prediction models were chosen, considering those most commonly used previously in the literature. This study attempts to test whether using time series lags improves the non-use of lags. The results obtained have shown that lags improve the results compared to a previous work in which no lags were used. (shrink)

Through earnings announcements, conference calls, and other press releases, corporate executives have an opportunity to frame the narrative of financial disclosures. Numerous studies have shown that textual tone significantly influences stock returns, suggesting that through word choice, upper management may impact market reaction. In this study, we examine the influence of CEO personality traits on corporate disclosures by analyzing the tone of earnings announcements for a sample of Fortune 500 CEOs over nearly two decades. Our hypotheses are twofold: that qualitative (...) disclosures in firms with narcissistic leaders will be biased upward and the bias will moderate as CEOs becomes older. Our empirical results support these hypotheses and suggest that more narcissistic CEOs tend to reinforce their grandiose self-image by issuing more positive earnings announcements but this desire wanes with CEO age. We also find that the stock market response to the tone of the earnings announcement is less pronounced for more narcissistic CEOs, suggesting the market takes into account the bias in narcissistic CEO announcements. The era of AI-based decision-making fast approaches, and anxiety is mounting about when, and why, we should keep “humans in the loop” (“HITL”). Thus far, commentary has focused primarily on two questions: whether, and when, keeping humans involved will improve the results of decision-making (making them safer or more accurate), and whether, and when, non-accuracy-related values—legitimacy, dignity, and so forth—are vindicated by the inclusion of humans in decision-making. Here, we take up a related but distinct question, which has eluded the (...) scholarship thus far: does it matter if humans appear to be in the loop of decision-making, independent from whether they actually are? In other words, what is stake in the disjunction between whether humans in fact have ultimate authority over decision-making versus whether humans merely seem, from the outside, to have such authority? Our argument proceeds in four parts. First, we build our formal model, enriching the HITL question to include not only whether humans are actually in the loop of decision-making, but also whether they appear to be so. Second, we describe situations in which the actuality and appearance of HITL align: those that seem to involve human judgment and actually do, and those that seem automated and actually are. Third, we explore instances of misalignment: situations in which systems that seem to involve human judgment actually do not, and situations in which systems that hold themselves out as automated actually rely on humans operating “behind the curtain.” Fourth, we examine the normative issues that result from HITL misalignment, arguing that it challenges individual decision-making about automated systems and complicates collective governance of automation. Los desafiantes cambios han impactado el aprendizaje, creando la necesidad de nuevas formas de aprender, como el aprendizaje autorregulado. Este enfoque facilita el desarrollo de competencias al fomentar la metacognición y el aprender a aprender. El objetivo de este estudio fue analizar investigaciones sobre el tema para extraer sus contribuciones. Se utilizó una revisión sistemática cualitativa, realizando búsquedas de artículos en Scopus, WOS y PubMed, tanto en inglés como en español, y se seleccionaron 30 documentos. Se evidenció que el aprendizaje (...) autorregulado contribuye de manera integral y significativa al logro de competencias, analizado a través de sus dimensiones cognitiva, metacognitiva, afectivo-emocional, relacional-social y ética. The generation of synthetic data is becoming a fundamental task in the daily life of any organization due to the new protection data laws that are emerging. Because of the rise in the use of Artificial Intelligence, one of the most recent proposals to address this problem is the use of Generative Adversarial Networks. These types of networks have demonstrated a great capacity to create synthetic data with very good performance. The goal of synthetic data generation is to create data (...) that will perform similarly to the original dataset for many analysis tasks, such as classification. The problem of GANs is that in a classification problem, GANs do not take class labels into account when generating new data, it is treated as any other attribute. This research work has focused on the creation of new synthetic data from datasets with different characteristics with a Conditional Generative Adversarial Network. CGANs are an extension of GANs where the class label is taken into account when the new data is generated. The performance of our results has been measured in two different ways: firstly, by comparing the results obtained with classification algorithms, both in the original datasets and in the data generated; secondly, by checking that the correlation between the original data and those generated is minimal. There is currently a consensus among comparative psychologists that nonhuman animals are capable of some forms of mindreading. Several philosophers and psychologists have criticized this consensus, however, arguing that there is a “logical problem” with the experimental approach used to test for mindreading in nonhuman animals. I argue that the logical problem is no more than a version of the general skeptical problem known as the theoretician’s dilemma. As such, it is not a problem that comparative psychologists must solve before (...) providing evidence for mindreading. (shrink)

In this article I present the analysis of the syncategorematic term ‘omnis’ in the commentaries on the Topics by the Parisian masters of Arts Boethius of Dacia and Radulphus Brito. I shall focus on the different relations between subject, predicate and particular instances that obtain in universally quantified statements, and in particular on the relations that obtain in universally quantified statements with an empty subject. I also attempt to highlight some continuities and ruptures with respect to this problem in its (...) 13th-century treatments, by comparing Boethius and Brito’s analyses with the earlier analyses put forth by Peter of Spain and William of Sherwood. This paper considers a host of definitions and labels attached to the concept of smart cities to identify four dimensions that ground a review of ethical concerns emerging from the current debate. These are: (1) network infrastructure, with the corresponding concerns of control, surveillance, and data privacy and ownership; (2) post-political governance, embodied in the tensions between public and private decision-making and cities as post-political entities; (3) social inclusion, expressed in the aspects of citizen participation and inclusion, and inequality and (...) discrimination; and (4) sustainability, with a specific focus on the environment as an element to protect but also as a strategic element for the future. Given the persisting disagreements around the definition of a smart city, the article identifies in these four dimensions a more stable reference framework within which ethical concerns can be clustered and discussed. Identifying these dimensions makes possible a review of the ethical implications of smart cities that is transversal to their different types and resilient towards the unsettled debate over their definition.
